By accessing or using the Wasenat Properties website, mobile application, or any related services (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Wasenat Properties Ltd ("Wasenat", "we", "us", or "our"), a company registered in Bangladesh under the Companies Act 1994.

We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting. Your continued use of the Services after any modification constitutes acceptance of the updated Terms. We will notify registered users of material changes by email.

Wasenat Properties provides an online platform for real estate listings, property search, agent discovery, and related advisory services in Bangladesh. Our Services include but are not limited to: property listing browsing, agent profile viewing, enquiry submission, newsletter subscription, and property valuation estimates.

All property listings are provided for informational purposes only. While we make every effort to ensure accuracy, Wasenat Properties does not guarantee that any information on our platform — including pricing, availability, dimensions, or legal status — is current, complete, or error-free.

We act as an intermediary between buyers, sellers, tenants, landlords, and developers. Wasenat Properties is not a party to any transaction between users and property owners or developers unless explicitly stated in a separate written agreement.

You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into binding contracts under applicable law.

If you are using our Services on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms, and references to "you" shall include that entity.

We reserve the right to refuse service, terminate accounts, or cancel enquiries at our sole discretion if we believe a user has violated these Terms or applicable law.

Certain features of our Services may require registration. When registering, you agree to provide accurate, current, and complete information and to update such information as necessary.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at legal@Wasenat.com.bd of any unauthorised use of your account.

Wasenat Properties will not be liable for any loss or damage arising from your failure to protect your account information. We reserve the right to terminate or suspend accounts that we reasonably believe have been compromised or are being used fraudulently.

Property listings on our platform are submitted by agents, developers, and private sellers. While we implement quality controls, Wasenat Properties does not independently verify all listing information including but not limited to: ownership title, encumbrances, legal disputes, physical dimensions, or construction quality.

Users are strongly advised to conduct independent due diligence, including engaging a qualified legal professional and structural surveyor, before entering into any property transaction. Reliance solely on information presented on our platform without independent verification is at your own risk.

Wasenat Properties reserves the right to remove, edit, or reject any listing at our discretion, including listings we deem misleading, fraudulent, inappropriate, or in violation of these Terms.

Pricing shown on listings is indicative only. Final transaction prices are subject to negotiation between the parties and may differ from listed prices. Currency values are shown in Bangladeshi Taka (BDT) unless otherwise stated.

All content on our Services — including text, graphics, logos, photographs, icons, images, audio clips, digital downloads, and software — is the property of Wasenat Properties Ltd or its content suppliers and is protected under applicable copyright and intellectual property law.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Services for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content without our prior written consent.

If you submit content to our platform — including property photographs, descriptions, or reviews — you grant Wasenat Properties a worldwide, royalty-free, perpetual licence to use, reproduce, modify, and display that content in connection with our Services. You warrant that you have the right to grant this licence.

You agree not to use our Services to: post false, inaccurate, misleading, defamatory, or fraudulent content; infringe on any intellectual property or other proprietary rights; transmit unsolicited commercial communications (spam); collect or harvest personal data about other users without consent; impersonate any person or entity; engage in any form of automated data collection (scraping, crawling, or mining) without our express written permission.

You may not use our Services for any unlawful purpose or in any way that could damage, disable, overburden, or impair our servers or networks. Any attempt to gain unauthorised access to our systems, accounts, or data is strictly prohibited and may be reported to law enforcement.

Listing the same property multiple times, manipulating search rankings, or posting misleading pricing designed to attract enquiries is prohibited and will result in immediate account suspension.

To the maximum extent permitted by applicable law, Wasenat Properties, its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising from your use of or inability to use the Services.

Our total liability to you for any claim arising from your use of the Services shall not exceed the amount you have paid to us in the twelve months preceding the event giving rise to the claim, or BDT 10,000, whichever is greater.

We make no warranty that the Services will be uninterrupted, timely, secure, or error-free. Property valuations and market estimates provided through our Services are for indicative purposes only and do not constitute professional financial or legal advice.

You agree to defend, indemnify, and hold harmless Wasenat Properties and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising from: your violation of these Terms; your use of the Services; your violation of any third-party rights; or any content you submit to our platform.

Wasenat Properties reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defences.

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Services will immediately cease.

You may terminate your account at any time by contacting us at legal@Wasenat.com.bd. Termination does not relieve you of any obligations incurred prior to termination, and any provisions of these Terms that by their nature should survive termination shall remain in effect.

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of Bangladesh, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or our Services shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts of Dhaka, Bangladesh.

Nothing in this clause shall prevent either party from seeking urgent injunctive or other equitable relief from a competent court where necessary to protect its rights.
